Terms of Service

These Terms of Service ("Terms") govern your access to and use of Debate Arena (the "Platform"), available at https://debate-arena.example, including all features, content and the in-app token economy (together, the "Service"). The Service is operated by the administrator of Debate Arena ("we", "us", "our"). You can reach us at support@debate-arena.example.
By creating an account, logging in, purchasing tokens, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
1.1 You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and to purchase tokens.
1.2 By using the Service you represent that the information you provide (including your email and date of birth) is accurate and that you are legally able to enter into a binding contract under the Contracts Act 1950 (Malaysia).
1.3 If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Accounts and authentication
2.1 Accounts are created and accessed using a one-time passcode (OTP) sent to your email address. You are responsible for keeping access to your email account secure.
2.2 You are responsible for all activity that occurs under your account. Notify us at support@debate-arena.example immediately if you suspect unauthorised use.
2.3 You may not share, sell, or transfer your account, and you may not create accounts using automated means or false identities.
3. The Service
3.1 Debate Arena is a discussion platform where users create debate topics and post short comments arguing one of two sides. Other users vote on those comments.
3.2 The Service is provided on an "as is" and "as available" basis. We may add, change, suspend, or remove features at any time without liability, subject to the Refund & Billing Policy for tokens you have already purchased.
4. Tokens and payments
4.1 The Service uses an in-app virtual credit called tokens. Tokens are required to perform certain actions (for example, creating a debate or posting anonymously).
4.2 Tokens are sold in token packs. Payments are processed by our third-party payment provider acting as the Merchant of Record. By purchasing, you also agree to that provider's terms at checkout.
4.3 Tokens are a limited, non-transferable, revocable licence to use a feature of the Service. They are not money, legal tender, a deposit, a security, or a stored-value instrument, and they have no cash value and cannot be redeemed for cash.
4.4 There are two types of tokens: permanent tokens (bought, or granted as a sign-up bonus or Platform event) which do not expire, and promo tokens (granted via promo codes) which expire on a due date and are then removed without refund. When you spend tokens, promo tokens are used first, then permanent tokens. Full details are in the Refund & Billing Policy.
4.5 All billing, pricing and refund rules are set out in the Refund & Billing Policy, which forms part of these Terms.
5. User-generated content
5.1 You retain ownership of the debate topics, comments and other content you submit ("Your Content").
5.2 You grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, and distribute Your Content solely for the purpose of operating, promoting and improving the Service.
5.3 You are solely responsible for Your Content. Your Content, and your conduct, are governed by the User Agreement and the Disclaimer / Content Policy, both of which form part of these Terms.
5.4 We do not endorse Your Content. Opinions expressed by users are their own and do not represent the views of Debate Arena or its administrator.
6. Moderation and removal
6.1 We use automated filters and user reports to identify content that may breach these Terms or Malaysian law.
6.2 We may, at our sole discretion and without prior notice, remove or restrict any content, and suspend or terminate any account, that we reasonably believe breaches these Terms, the Disclaimer / Content Policy, or applicable law (including the Communications and Multimedia Act 1998, the Sedition Act 1948, and the Penal Code).

7. Prohibited conduct
You agree not to use the Service to break the law or to do anything listed in the Disclaimer / Content Policy. This includes, without limitation, posting unlawful, violent, hateful, harassing, defamatory, seditious, obscene, or infringing content, or attempting to disrupt, reverse-engineer, or gain unauthorised access to the Service.
8. Intellectual property
8.1 The Service itself — its software, design, logos, and branding — is owned by us or our licensors and is protected by Malaysian and international intellectual property law.
8.2 Except for Your Content and the limited token licence in clause 4, nothing in these Terms grants you any right in the Service.
9. Third-party services
The Service relies on third parties (for example, our payment, email, hosting and analytics providers). We are not responsible for the acts or omissions of those third parties, and your use of their services may be subject to their own terms.
10. Disclaimers
10.1 To the maximum extent permitted by Malaysian law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content is accurate. See the Disclaimer / Content Policy.
11. Limitation of liability
11.1 To the maximum extent permitted by Malaysian law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service.
11.2 Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for tokens in the three (3) months before the event giving rise to the claim, or (b) RM50.
11.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Malaysian law.
12. Indemnity
You agree to indemnify and hold harmless Debate Arena and its administrator from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or any law.
13. Suspension and termination
13.1 You may stop using the Service at any time and may request account deletion at support@debate-arena.example.
13.2 We may suspend or terminate your access at any time for breach of these Terms or applicable law. On termination, your right to use the Service ends immediately. Unused tokens are dealt with under the Refund & Billing Policy.
14. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept the revised Terms.
15. Governing law and jurisdiction
15.1 These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to conflict-of-law rules.
15.2 You submit to the exclusive jurisdiction of the courts of Malaysia for any dispute arising out of or relating to these Terms or the Service.
16. General
16.1 If any provision is held unenforceable, the remaining provisions stay in effect.
16.2 Our failure to enforce any right is not a waiver of that right.
16.3 These Terms, together with the policies they reference, are the entire agreement between you and us regarding the Service.
